    • Pr. 73, propr.? 72. If the notice of his death in Schol. Gron. p. 224St (in 72 or 71) is incorrect, and there is no hint in Cic. Verr. 2.2.37 and 2.4.42 (or in other evidence, MRR 2.109 and 117) that he had been killed, it becomes possible to identify him with the base-born friend of Crassus (Cic. Brut. 242), and the potential candidate for the consulship of 58 (RE no. 8), who had in any case held a praetorship before 63 (MRR 2.161).     • Instead of succeeding Verres in Sicily, he took part in the war against Spartacus, probably assisting the Consul Gellius against Crixus, a subordinate of Spartacus, and sharing the Consul's defeat (Cic. Verr. 2.2.37, and 4.42; Liv. Per. 96, praetor,' cf. App. BC 1.117; Ps.-Ascon. 185, 188, and 260 Stangl; Schol. Gron. 324 Stangl). (Broughton MRR II)
