    • 8 The praenomen is probably Marcus rather than Manius, see Boissevain on Dio 42.12. 1. The readings in the Mss of Caesar in the passages cited support this view, perhaps also the inscription on a coin of Panormus (Bull. Inst. Arch. Rome 1834, 74, M. ACIL.), if he is the person named. He is probably to be identified with the Marcus Acilius (text reading Aemilius) who held command of legions in Greece in 45 (Nic. Dam. Vit. Caes. 16, FGrH 2A.398, line 20). Grant (From Imperium to Auctoritas 17) holds that the Proconsul in Sicily was named Manius Acilius, but that the commander of the legions in Greece in 45-44 was Marcus Acilius, the future Consul Suffectus of 33, and identifies him with an unnamed Quaestor pro praetore in Macedonia in this period. The cognomen appears in the Mss of Caesar BC 3.39. 1, and the combination M. Acilius Caninus in ILS 892. (Broughton MRR II)

The form of the praenomen and the cognomen of Caesar's legate in 48 (MRR 2:280) and the proconsul of Sicily in 46 (MRR 2.296) is almost surely settled by the record of the name in an Ostian inscription as M. Acilius Caninus (ILLRP 435; cf. MRR 2.285, note 8), probably a son. See Shackleton Bailey, Studies 5; CLF 2.435-436; and CQ 10, 1960, 257, note 1. Sumner has shown that his praetorship in 47 (listed in MRR 2.287, on the basis of his proconsulate in 46) is very uncertain in this period under Caesar (Phoenix 25, 1971, 261). He was probably the Acilius who was in Graeciam cum legionibus missus in 45, and whom Cicero had twice defended on a capital charge (Cic. Fam. 7.30.3, and 31.1; cf. 13.50; MRR 2.308).
